Doctot-branded Applications (which should be used by suitably trained Medical Professionals only) are the sole property of Doctot. Commercial reproduction, distribution or transmission of any part or parts of such Apps or any information contained therein by any means whatsoever without the prior written permission of Doctot is not permitted. Your use of Doctot's Apps is subject to the TERMS AND CONDITIONS set out below. You should read them carefully before going any further. By using Doctot's Apps, the user ("user" or "you") agree to the following terms of use. If you do not agree to these terms of use, you should immediately exit the Doctot App in question.

1. OWNERSHIP

Doctot-branded Apps and all intellectual property rights (including but not limited to rights in the App as a database) in its design, text, graphics, audio and the selection and arrangement thereof belong to Doctot or its respective licensors. The trade marks, logos and trade names depicted in Doctot's Apps are proprietary to Doctot save for any trade marks, logos and brand names of other third party licensors.


2. LIMITED LICENCE; RESTRICTIONS

You are granted a limited licence to download the materials contained in Doctot's Apps to a single mobile device, solely for personal, non-commercial use, and provided all copyright, trade mark and other proprietary notices are left intact. Use of Doctot App material is strictly prohibited. The grant of this limited licence is conditional upon your agreement to and compliance with all these terms of use. Any other use of any of the materials in Doctot's Apps including reproduction (for any purposes other than those noted above), modification, distribution, or republication, without the prior written permission of Doctot is strictly prohibited, and is a violation of Doctot's (and/or its licensor(s) intellectual property rights). If you download any material, the material, including but not limited to any images or files incorporated in or generated by the material, and data accompanying the material (collectively, the "Material"), the downloading of any such material shall be subject to the limited licence set out above.

Doctot and/or their respective licensors (as the case may be) shall retain all right, title, interest and intellectual property rights in and to the material. You may not distribute, sell, or transmit the Material nor alter, modify or adapt the Material, including but not limited to translating, decompiling, reverse engineering, disassembling, or creating derivative works there from other than to the extent permitted by applicable law. In addition, you will not use (other than to the extent permitted by applicable law) any Software or other materials (of whatever nature) contained or capable of being downloaded to develop, design, produce, manufacture, sell and/or distribute any product of whatever nature nor will you permit any third party to do any of the above.


3. DISCLAIMER

DOCTOT'S APPS AND THEIR CONTENTS ARE PROVIDED "AS IS" AND WITHOUT ANY REPRESENTATION, TERM, CONDITION OR WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED (AND WHETHER IMPLIED BY LAW, CUSTOM OR OTHERWISE) IN RESPECT OF THE APP AND/OR ITS CONTENTS. DOCTOT DISCLAIMS ALL REPRESENTATIONS, TERMS, CONDITIONS AND WARRANTIES INCLUDING, BUT NOT LIMITED TO, AS TO SATISFACTORY QUALITY, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT OF INTELLECTUAL PROPERTY RIGHTS TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW. IN ADDITION, DOCTOT EXCLUDES ANY REPRESENTATION OR WARRANTY THAT THE INFORMATION AND/OR FACILITIES ACCESSIBLE VIA THEIR APPS ARE ACCURATE, COMPLETE OR CURRENT, OR THAT THEIR APPS WILL BE FREE OF DEFECTS INCLUDING, BUT NOT LIMITED TO, VIRUSES OR OTHER HARMFUL ELEMENTS. THE USER OF A DOCTOT APP (WHO MUST BE A QUALIFIED MEDICAL PROFESSIONAL) ASSUMES ALL COSTS AND RISKS ARISING AS A RESULT OF ITS USE OF THE APP IN QUESTION.


4. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, NEITHER DOCTOT NOR ANY OF ITS DIRECTORS, EMPLOYEES, AFFILIATES OR OTHER REPRESENTATIVES WILL BE LIABLE FOR ANY LOSS OR DAMAGE ARISING OUT OF OR IN CONNECTION WITH THE USE OF, OR INABILITY TO USE, THE MATERIALS IN AND/OR FACILITIES OR SERVICES OFFERED THROUGH THEIR APPS INCLUDING, BUT NOT LIMITED TO, INDIRECT OR CONSEQUENTIAL LOSS OR DAMAGE, LOSS OF DATA, INCOME, PROFIT OR OPPORTUNITY, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES, EVEN IF DOCTOT HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS OR DAMAGES AND/OR SUCH LOSS OR DAMAGE WERE REASONABLY FORESEEABLE. IN NO EVENT WILL DOCTOT'S TOTAL LIABILITY FOR ALL DAMAGES, LOSSES, AND CLAIMS (WHETHER IN CONTRACT, TORT (INCLUDING, BUT NOT LIMITED TO, NEGLIGENCE), OR OTHERWISE) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE APP IN QUESTION.


5. GOVERNING LAW

Doctot excludes all representations and warranties that materials in and/or facilities or services offered through their Apps are available for use in other locations, or that they comply with any legal or regulatory requirements of such other locations. Those who choose to access Doctot Apps do so at their own risk and on their own initiative and are responsible for compliance with applicable local laws. These terms shall be governed by and construed in accordance with Irish law. Any dispute under these terms shall be subject to the exclusive jurisdiction of the Irish courts and, by using Doctot Apps, you hereby submit to the non-exclusive jurisdiction of such courts for such purposes and waive any and all objections to jurisdiction or venue in such courts.


6. MISCELLANEOUS

If any court of competent jurisdiction finds any provision of these terms to be void or unenforceable for any reason then such provision shall be ineffective to the extent of the court's finding without affecting the validity and enforceability of any remaining provisions.

Those who choose to access this website do so at their own risk and on their own initiative and are responsible for compliance with applicable local laws. These terms shall be governed by and construed in accordance with Irish law. Appendix: User Content Instructions

Doctot may allow users to submit content and materials (including but not limited to text, photographs and videos) for use on/in Doctot’s websites, social media channels and products. The content and materials a user posts or submits for use on/in Doctot’s websites, social media channels and products shall be deemed “User Content”. When submitting User Content, users agree to the following submission criteria (“Instructions”), and to any other terms and conditions (which are further detailed in the Legal section of www.doctot.com).

1) Submitted User Content

Doctot would like to make it clear that under no circumstances should a user’s User Content threaten or disparage others. This includes but is not limited to defaming others, libelling others, harassing others, intimidating others, using hateful language or making negative remarks related to race, national origin, religion, gender, sexual preference or age. The user’s User Content should neither disclose confidential or personal information about another; that is unless the person in question has provided consent. User Content should neither violate another’s publicity or privacy rights nor include information the user must keep confidential under contract. Users also agree that the User Content they provide is complete, accurate and has been exclusively created by themselves and not plagiarised or copied from another source. If a user did not create their User Content, those that either created it or helped to create it must provide permission prior to the submission of such User Content. Before submitting it, the user must obtain both consent and a release from the person (or where relevant, the legal guardians of the person in question), the person in question being fully aware that Doctot may utilise such content in a variety of different ways.

2) User Content posted on Doctot’s Social Media Channels and Websites

When posting on Doctot’s Social Media Channels et al, the user must agree to be respectful and polite to others at all times. While the sharing of comments, photos, videos and web-links is encouraged by Doctot, it should be noted that posted content doesn’t represent the views or opinions of Doctot or its affiliates. Content that Doctot considers offensive, inappropriate or not keeping with the spirit of the channel (including but not limited to posts that contain advertising or spam, posts that are off-topic or reflect irresponsible practices or contain vulgar language, posts that may violate the rights of others and/or posts that may violate Doctot’s terms of use) may be removed while the right to block users from posting content is also reserved. By submitting or uploading comments, photographs or video, the user is granting Doctot permission to use, publish, and otherwise reproduce, modify and distribute content with or without the user’s name in perpetuity, on a worldwide basis, for any lawful purpose, in any and all Doctot related media. Such uses may include but are not limited to: information, education, promotion of Doctot and/or its products via websites, mobile apps and social media channels. If people other than the user appear in a photograph or video, the user must have permission to use the photograph or video from the people in question.

3) User Content Submitted for use in Doctot Products

Users (including but not limited to the creators of medical calculators, equations, guidelines or formulas) agree that any submitted material or content (including but not limited to ideas, suggestions, questions or comments) will be treated as non-proprietary and non-confidential. Users grant Doctot a worldwide, royalty-free, perpetual right and licence to all or any portion of the submitted content, a right and licence that is unlimited, unrestricted, unconditional and irrevocable. Doctot may use this license to use product-related content in any fashion and for any purpose, including but not limited to displaying it, publishing it, broadcasting it, transmitting it, modifying it, editing it, reformatting it, trading it, translating it, storing it, copying it, distributing it, and hosting it. In any format, and in all media that currently exists, or may potentially exist in the future, such content may be used and published. Without entitlement to compensation, the user agrees that Doctot may for any purpose use any part of their content, including any techniques, ideas or concepts. To exemplify potential use, such user content may potentially be utilised to help design, develop, produce and market technology products. To third parties, Doctot shall also have permission to sub-license any of these rights. In addition, the user should note that their content may be searched and may be accessed by others. The user also represents and warrants that they own their content and that they have the right to grant a license as described above. The user further represents and warrants that Doctot’s use of their content will not violate anyone else’s intellectual property rights, or any other rights of any other person or entity. The user also represents and warrants that Doctot’s use of their content will not place Doctot in breach of any applicable laws. The user understands and acknowledges that Doctot possess in-house expertise who may have developed or may in the future develop ideas similar or virtually indistinguishable to the user’s content. The user also appreciates that that Doctot is only willing to consider the submissions of user content on these particular terms.

4) Alterations to Instructions

Doctot reserve the right to make changes to the above instructions. Users are advised to check this page on a regular basis to become aware of any such changes. If a user continues to use Doctot’s products and services after changes to the instructions on this page had been made, the user is bound by such changes. If the user does not accept these changes, the user must stop submitting content to Doctot’s products, websites and social media channels. In the event of any conflict between the User Content terms and Doctot’s Terms and Conditions, Doctot’s Terms and Conditions shall overrule, and be applied.
